Sports federations, in order to obtain accreditation, must fulfill several obligations, including that of having disciplinary regulations in accordance with standard regulations adopted by Decree. These regulations notably set the rules of disciplinary procedure to be followed by the committees of the sports bodies (federation, league and committee).
The rules of disciplinary procedure laid down by the standard regulations for sports federations
According toArticle L.131-8 of the Sports Code, a federation can only be approved by the Ministry of Sports if it has adopted:
- statutes with certain mandatory provisions;
- and a disciplinary regulation in accordance with a model regulation.
Defined by decree in the Council of State, after consulting the French National Olympic and Sports Committee, it can be consulted at theAppendix I-6 Sports Code.
This model regulation fixes in particular the disciplinary procedure rules to be followed by the (first instance and appeal) committees of the sports bodies (Federation, League and Regional Committee).
This model regulation sets out the main rules that must apply in disciplinary matters such as:
- respect for the rights of the defense (EC 26 1945 October, Aramu);
- obligation of impartiality of the disciplinary body (EC, November 30 1994, Bonnet);
- impossibility of aggravating a disciplinary sanction on the only recourse of the person whom it struck (EC, March 16 1984, Moreteau).
Disciplinary regulations of sports federations
Approved sports federations (and delegatees) must have adopted disciplinary regulations in accordance with the standard disciplinary regulations.
