On the occasion of its last meeting, the International Council of Arbitration for Sport (ICAS), the body that manages the Court of Arbitration for Sport (CAS), has elected a new President of the Ordinary Arbitration Division CAS and amended its Code.

According to the CAS press release, the new President, Me Malinvaud, is a specialist in international arbitration, President of the French International Arbitration Commission of the International Chamber of Commerce (CCI France) and former President of the French Arbitration Committee.

A modification of the CAS Arbitration Code

ICAS also modified some provisions of the Sports Arbitration Code, as well as the scale of arbitration fees.

These changes will take effect in January 1er 2017.

In particular, the scale of arbitration fees has been modified:

  • Registry fee : each litigant to a dispute submitted to CAS arbitration is required to make a minimum payment of CHF 1000 as Registry fees for its arbitration request or its appeal request.
  • Administrative costs : CAS sets the costs for each arbitration according to the calculation table below, or at its discretion when the amount in dispute is not declared or there is no value in dispute.
  • Fees and expenses of the arbitrators : the amount of fees due to each arbitrator is set by the Secretary General of the CAS on the basis of the work provided by each arbitrator and on the basis of the time reasonably devoted by the Panel to the execution of its mission.
