The proposed sports ethics law was finally adopted

Wednesday February 15 2017, the Senate finally adopted the law proposal to preserve the ethics of sport, to strengthen the regulation and transparency of professional sport and to improve the competitiveness of clubs.

The main provisions of the bill aimed at preserving the ethics of sport, strengthening the regulation and transparency of professional sport and improving the competitiveness of clubs

The provisions of the text provide in particular:

    • the establishment of ethics and professional conduct charters by delegated sports federations, and committees responsible for ensuring their application (Article 1);
    • the submission of the presidents of sports federations, professional leagues, the French National Olympic and Sports Committee and the French Paralympic and Sports Committee to the requirements of the law relating to the transparency of public life (Article 2);
    • the prohibition, for players in sports competitions, to bet on competitions in their discipline (Article 7 and 8);
    • the extension of the competence of the French Agency for the Fight against Doping to mechanical and technological fraud (Article 9);
    • new provisions for agents from a Member State of the European Union (Article 11);
    • the expansion of the role and powers of the National Management Control Departments (Article 12);
    • the institution of a right to use, by sports societies, the affiliation number issued by federations to associations (Article 14);
    • the possibility for sports associations and societies to pay royalties to sportsmen or professional coaches they employ, for the commercial use of their image, name or voice (Article 17);
    • the right, for local authorities or their groups, to grant their guarantee to loans contracted for the acquisition, construction or renovation of sports equipment by sports associations or companies (Article 18);
    • the creation of a Standing Women's Sport Conference responsible for promoting the development and media coverage of women's sport (Article 21);
    • the possibility, for those involved in sport and the broadcasting of sports audiovisual content on the internet, to conclude agreements with a view to combating the promotion, access and making available online, unlawfully, of sports content (Article 24).

Adoption of Law No. 2017-261 of March 1, 2017

The Law was published in the Official Journal on March 2, 2017 and therefore became Law No. 2017-261 of March 1, 2017 aimed at preserving the ethics of sport, strengthening the regulation and transparency of professional sport and improving the competitiveness of clubs.
