Football: Fifa sanctioned several clubs for non-compliance with the prohibition of TPO

Fifa indicated, on March 29, 2016, that its Disciplinary Commission imposed a sanction on four clubs (Santos, Sevilla, Sint-Truiden and Twente) for "infringement of the rules of influence by third parties and / or the ownership of the economic rights of players by third parties".

Article 18bis of the FIFA Regulations on the Status and Transfer of Players

The press release recalls that the prohibition of influence by third parties set out in article 18bis of the Regulations on the Status and Transfer of Players entered into force on January 1, 2008. This article was then amended on May 1, 2015 , date on which the prohibition of third party ownership (TPO) came into force (Article 18ter).

Sanctions pronounced by the FIFA Disciplinary Committee

Santos club

The club Santos (Brazil) was fined CHF 75, a reprimand and a warning for violating art. 000bis (18 edition), as well as annex 2008 of the regulations. The club is thus found guilty "to have signed contracts on transfer and employment issues allowing third parties to influence the independence of the club, not to have declared information that is however mandatory in the system of regulation of international transfers, and to not having cooperated with FIFA TMS in connection with the latter's investigations".

Sevilla FC

FC Seville (Spain) was fined CHF 55 and a warning for violating art. 000bis (18 edition), as well as annex 2012 of the regulations. The club was found guilty "to have signed contracts on transfer and employment issues allowing third parties to influence the independence of the club and not to have declared information that is however mandatory in the system of regulation of international transfers".

The club of Sint-Truiden

The club Saint-Trond (Belgium) was fined CHF 60, a reprimand and a warning for violating art. 000bis and art. 18ter al. 18 (1 edition) of the regulations. The club was found guilty "to have signed contracts on transfer and employment issues allowing third parties to influence the independence of the club, not to have declared information that is however mandatory in the system of regulation of international transfers and have signed an agreement granting rights to a third party in connection with the future transfer of a player".

FC Twente

Finally, the FC Twente (Netherlands) was fined CHF 185, a reprimand and a warning for violating art. 000bis (18 edition), art. 2012ter, al. 18 (5 edition), as well as annex 2015 of the regulations. The club was found guilty "to have signed contracts on transfer and employment issues allowing third parties to influence the club, not to have submitted in TMS an agreement on the ownership of players' economic rights by third parties, having violated confidentiality rules and not having declared information that is nevertheless mandatory in the system of regulation of international transfers".

As a reminder, FC Twente had already been banned from European competition by the Licensing Commission of the Dutch Federation for not respecting the ban on the TPO.
