The French National Olympic and Sports Committee (CNOSF) published, in January 2020 on its website, the device for applying rule 40 of the Olympic Charter for the French Olympic delegation, allowing, on the one hand, participants to promote their sponsors and partners, and secondly, sponsors and partners to use the image of the participants during the period of the Tokyo 2020 Olympic Games.

According to the CNOSF, rule 40 of the Olympic Charter is an article: 


"which sets out the principles governing the use of the image of participants in the Olympic Games, for advertising purposes, during the period of the Olympic Games."


Paragraph 3 of the implementing text of rule 40 of the Olympic Charter provides:


"Competitors, team officials and other team personnel participating in the Olympic Games may allow their person, name, image or sports performance to be used for advertising purposes during the Olympic Games in accordance with the principles laid down by the IOC Executive Board. "

Focus on the part of the system relating to non-Olympic partners

This part of the system conditions, during the period of the games, the use by participants of their personal image and their name within the framework of an agreement with a non-Olympic partner, and the use by non-Olympic partners of the image and name of the participants.

For example, during the period of the Tokyo 2020 Olympic Games, the participants :


"can send a simple thank you message by non-Olympic personal partner on their personal websites and / or their personal social media accounts.
  • not state, explicitly or implicitly, that a particular product or service has contributed to improving the participant's performance;
  • not display personal support for a particular product or service;
  • respect the policies of the International Olympic Committee (IOC), the CNOSF and Paris 2024 which define activities incompatible with the values ​​of the Olympic Movement, or the limits on the use of images or videos of the athlete wearing the official uniform of his delegation national Olympic medal or any Olympic medal. "
The non-Olympic partners of participants, as far as they are concerned :


"are authorized to use the image of participants for advertising purposes during the Games period, under the following conditions:

      • obtain the consent of the participants concerned;
      • respect the policies of the IOC, the CNOSF and Paris 2024 which define activities incompatible with the values ​​of the Olympic Movement (ex: bans related to tobacco, alcohol or immoral activities, ...);
      • not use any of the Olympic properties;
      • have generic advertising that complies with the rules defined by the IOC, Tokyo 2020 and / or the CNOSF and Paris 2024. "

The Ad Hoc Commission

In order to ensure a fair application by the participants of the mechanism of rule 40 of the Olympic Charter during the Olympic Games Tokyo 2020, an ad hoc Commission will be set up. 


This Commission may impose the following sanctions in the event of non-compliance with the aforementioned enforcement system:


"a warning, exclusion from the village, withdrawal of accreditation, reimbursement by the participant of the costs incurred by the delegation for its participation in the Games and / or financial sanctions."
