Amateur clubs react to the Order of the Council of State of June 11, 2020 which did not suspend the decision of the Executive Committee of the French Football Federation (FFF) of April 16, 2020.

The amateur clubs concerned have taken note of the summary order issued on June 11, 2020 by the Council of State under which the Comex decision of April 16, 2020 has not been suspended.

However, they note with hope that the Ordinance rightly recalls that the Comex must report these decisions to "nearest Federal Assembly".

Having just learned that after having canceled the holding of the Federal Assembly which had been fixed for June 6, 2020 (which the clubs complained about), the Federation has just convened a Federal Assembly on June 26. The clubs wish to be heard by the electors so that on this occasion, they can usefully debate and present significant amendments to the regulatory changes set by the Comex of April 16 and May 11, 2020.

If the desire of the Comex has been to create a national harmonization of the treatment of championship classifications, the fact remains that this choice has generated situations of injustice and sporting inequality leading to an unfairness of the contested competition ( with amateur championships played on average at 57% and many competitions below 40% of matches played).

The Federal Assembly of June 26, 2020 must allow, both the Federation and the Leagues and Districts, to be able to adopt provisions or take overriding decisions, taking into account exceptional circumstances in order to respond to a deep feeling of injustice.

The loss of chance of accession is less penalizing than the loss of chance of staying in a championship.

The rules applied for the end of the 2019/2020 season generate real concern and a risk of sporting values ​​drifting if such circumstances should arise again, because the arithmetic and administrative management to determine the accessions and relegations of the coming seasons, cannot respond to these values, the respect of which is imposed on Clubs which must themselves convey them to their licensees.

The resulting misunderstanding must be at the heart of future reflections and decisions.

Finally, the clubs concerned intend to recall that in the coming months, the Council of State will have to rule within the framework of the substantive procedure still in progress, on the annulment of the Comex decision April 16, 2020. In the state, the rejection of the request for suspension of this decision in no way calls into question this request.

In this regard, the clubs regret the daring reading that the Federation makes of the summary order by daring to claim that the Council of State would recognize the legality of the decision or would salute the quality of the work provided by the bodies of amateur football.

However, the clubs concerned intend to look to the future, which passes, in the short term, by the Federal Assembly of June 26, 2020, which must, in the best interest of football, take into account their just grievances.
