Therapeutic Use Exemption (TUE)

Article L. 232-2 of the Sports Code allows athletes to obtain a therapeutic use authorization (TUE) in order to undergo treatment with drugs containing a prohibited substance.

Article L 232-2 of the Sports Code specifies:

“Therapeutic use authorizations are granted by the French Anti-Doping Agency, after the assent of a committee of experts placed with it. This committee is made up of at least three doctors. "

The conditions for issuing TUEs by AFLD

Article D 232-72 of the Sports Code specifies that " the authorization for the therapeutic use of a prohibited substance or method [...] is issued by the French Anti-Doping Agency when each of the following conditions is met on a balance of probabilities:
1 ° The athlete suffers significant health damage if the prohibited substance or method can not be administered to him during the management of an acute or chronic medical condition; 


2 ° Therapeutic use of the Prohibited Substance or the Prohibited Method is unlikely to produce any improvement in performance other than that attributable to a return to normal health status after the therapeutic treatment of a known medical condition ;


3 ° There is no other therapeutic solution that allows the use of a substance or method that is not prohibited;


4 ° The necessity to use a prohibited substance or method is not a partial or total consequence of the non-therapeutic use of a prohibited substance or method at the time of that use .
Apart from any proven pathological condition, the use of a prohibited substance or method to increase the endogenous hormone levels of an athlete cannot give rise to the granting of an authorization for use. for therapeutic purposes. "
